Complaint received under Part 3 (Advertising and Promotion)

  • The ABHI received reciprocal complaints from two member companies.
  • The complaints alleged breaches of Part 3 of the ABHI Code regarding Advertisements addressed to HCPs, specifically paragraphs 2.1, 2.3 and 3.1.
  • The ABHI invited the companies to attempt to resolve the outstanding disputed matters by structured mediation, convened by the ABHI.
  • In preparation, the ABHI invited the two companies to:
    • engage in intercompany dialogue; and
    • exchange position statements.
  • These steps helped narrow the matters in dispute.
  • The structured mediation was supervised by the ABHI and took place virtually. 
  • This mediation resolved the matters in dispute and led to both companies making agreed changes to their marketing materials, without the need to convene the Panel.
